What type of information is collected by Faux Fan®? How is it used?

In general, there are two types of information involved when you are accessing Faux Fan® – information you provide to us, either through account creation, buying our products, or by signing up for product updates and information from us. This information is considered “personally identifiable information.” The other type of information is information that is collected by monitoring and tracking on the website. This information is considered “non-personally identifiable information,” as it doesn’t identify you personally.

Personally Identifiable Information (PII)

Faux Fan® uses PII to operate, maintain, enhance, provide, create, and develop all of the features, functionality, and services (new or existing) found on the Faux Fan® website; provide security for our websites, products, software, or applications; improve your experience with the Faux Fan® by providing content and product recommendations and by delivering content and products that we hope you will find relevant and exciting; allow you to comment on content and products; prevent fraud and abuse; and understand the usage and buying trends of our users.

We use your email address to communicate with you for customer service purposes, to contact you with information about purchases you have made from our Site, and to contact you regarding any content that you have posted to or downloaded from Faux Fan®.

In some instances, we have a legal obligation to collect and process your personal information (such as our obligation to share data with tax authorities).

Faux Fan® will not collect or process any information, unless required by law, concerning your:

Race or ethnic origin
Political opinions
Religious or philosophical beliefs
Trade union memberships

Consent

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return of a purchase, you are giving consent for us to collect and use that information for that specific purpose only.

We may also ask you to opt-in (consent) for us to use your personal information for other specified uses, such as sending you product or services updates or other marketing information. If you consent to these additional specified uses, you may withdraw your consent at any time, and we will stop processing of your data for that purpose.

Non-personally Identifiable Information

When you visit our Site, our servers automatically collect and recognize specific non-personally identifiable information such as your domain, IP address, Web browser, operating system, the address of any referring site, and any device identifier (if using a mobile device). When we do get that type information, in general we may use it to try and tailor information to better fit what we think you may be interested in, to help us improve the experience of all of our website visitors, and to help us look for ways to continually upgrade and improve the performance of our website, in addition to site content. We also use this information more generally to (1) monitor and analyze use of our Site and our Service, (2) facilitate technical administration of our Site, (3) increase the functionality and user-friendliness of our Site and our Service, and (4) better tailor our Site and Service to our visitors' needs.

Just as with the personally identifiable information you key in, we don’t market or sell any of this information that we collect to any third party.

Who do you share the information with?

We disclose such information to service providers working on our behalf, such as, to provide website hosting, maintenance, and security services; conduct data analysis and create reports; offer certain functionality, assist in improving our products and services, or creating new features. We require that these parties to process such information in compliance with this Privacy Policy; we authorize them to use the information only for the purposes for which it is provided to them; and we require them to use reasonable confidentiality measures.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies with respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the way your personal information will be handled by these providers.

Remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So, if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or Fax Fan’s® Terms of Service.

Be aware that we may disclose your information if we believe, in good faith, that such disclosure is necessary to comply with U.S. state and federal laws, or other applicable laws around the world, for example, the country of your residence. We will also disclose such information under a court order, judicial request, subpoena or legally issued warrant.

Faux Fan® may also disclose information that is appropriate or necessary to protect us from potential liability or other fraudulent, abusive or unlawful uses.

Shopify

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment

` If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

What if my information is wrong, or needs to be updated?

You may review, correct, update, or delete your personally identifiable information through your account or by contacting our Support Team during regular business hours. If you completely remove all personally identifiable information, your account will become deactivated, and you will no longer have access to Faux Fan’s® products or services. If you would like us to remove your records in our system, please email support@fauxfan.com with your request. We will use commercially reasonable efforts to honor your request but may retain an archived copy of your records as required by law or for other legitimate business purposes.

California law permits users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information (as defined by California Law) for their direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed to those parties. Faux Fan® does not currently disclose personal information to third parties for their direct marketing purposes.

The European Union’s General Data Protection Regulation (GDPR) allows European citizens to submit a user access request to determine how we have used their data. Within 30 days of receiving a user access request, Faux Fan® will provide you the following information, free of charge:

What personal information of yours we are processing;
Why we are using this information;
Who has access to this information;
How this information is being used in automated decisions; and
What processes are using this information?

Account Closure and Deletion

If you would like to close your account and delete your profile information on Faux Fan®, go to your login page. If you close your account, Faux Fan® may retain certain information about you for the activities described in this Privacy Policy, or as permitted or required by applicable law.

Does Faux Fan® use cookies?

A cookie is a piece of data stored on the user’s computer tied to information about the user. Usage of a cookie is in no way linked to any personally identifiable information while on our site. We use both session ID cookies and persistent cookies. For the session ID cookie, once users close the browser, the cookie terminates. We use session cookies to make it easier for you to navigate our Web site. A persistent cookie is a small text file stored on the user’s hard drive for an extended period. Persistent cookies can be removed by following directions in your internet browser.

By setting a persistent cookie on our site, users don’t have to log in more than once, thereby saving time (and frustration) while on our website. If users reject the cookie, they may still use our site, however you will be limited in some areas of our website. Persistent cookies enable us to track and target the interests of our users to enhance the experience on our website.

What type of security does Faux Fan® use?

We use a variety of reasonable managerial, technical, and physical measures and follow industry best practices to protect the integrity and security of your information. In short, we do our best to make sure your personal information is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with an AES-256 encryption. We follow all PCI-DSS requirements and implement additional generally accepted industry standards. However, no method of transmission over the Internet or electronic storage is 100% secure. Accordingly, we cannot warrant or otherwise ensure that the information you transmit to us will be completely secure. Any information you send to us is sent at your own risk, and we cannot guarantee that our managerial, technical, or physical controls will not be breached.

How does Fax Fan handle links to other websites?

Our website may contain links to other websites that are created and maintained by others. Though the existence of a link on our website probably means that we think you’ll find the information interesting, we can’t guarantee the accuracy or completeness of anything on those websites, and we don’t assume any responsibility for anything contained on those sites. Also, their privacy policies may be different than ours, and their websites are not governed by this Privacy Policy. To be sure your information is protected, we encourage you to review the terms of service and privacy policies of websites external to ours.

International Data Transfers

Information collected by Faux Fan® may be stored and processed in your region, in the United States (for instance in our major data centers), or in any other country where Faux Fan® or its affiliates, subsidiaries, partners, or service providers are located or maintain facilities. If we provide any information about you to any such entities, we will take appropriate measures to ensure such companies protect your information adequately in accordance with this Privacy Policy and applicable law.

Children’s Privacy

IF YOU ARE UNDER 13 YEARS OF AGE, THEN PLEASE DO NOT USE OR ACCESS FAUX FAN’S® PRODUCTS OR SERVICES WITHOUT EXPLICIT PERMISSION FROM YOUR PARENTS.

Faux Fan’s® Site contains products and services appropriate for a wide range of audiences, including children. Protecting the privacy of young children is important to Faux Fan®. To protect young children, Faux Fan® complies with the Children’s Online Privacy Protection Act 15 U.S.C. § 6501–6506 (“COPPA”). Faux Fan® does not condition a child’s participation in any online services on the disclosure of more information than is reasonably necessary to participate in the activity.

During the Faux Fan® purchase or registration process, we may ask children to provide certain information for notification and security purposes, such as a parent or guardian’s email address, the child’s first name and gender, the child’s member or account username, and password. Faux Fan® may collect and store persistent identifiers (e.g., cookies, IP addresses, etc.) from Children without parental consent for the purpose of supporting the internal operations of the service or as otherwise permitted under COPPA.

If you are the parent or legal guardian of a child under the age of 13 who has created an account with Faux Fan®, please contact us at support@fauxfan.com to have that child’s account terminated and personal information deleted.

Parental Rights

In the event Faux Fan® wishes to collect personal data from a child, COPPA requires that we first seek a parent or guardian’s consent by email. In the email we will explain what information we are collecting, how we plan to use it, how the parent can provide consent, and how the parent can revoke consent. If we do not receive parental consent within a reasonable time, we will delete the parent contact information and any other information collected from the child in connection with that activity.

At any time, parents can refuse to permit us to collect further personal information from their children in association with a particular account and can request that we delete from our records the personal information we have collected in connection with that account. Please keep in mind that a request to delete records may lead to a termination of an account, membership, or other service.

Where a child has registered for a Faux Fan® account, we use two methods to allow parents to access, change, or delete the personally identifiable information that we have collected from their children:

Parents can request access to and delete their child’s personal information by logging on to the child’s account through the Faux Fan® website. Parents will need their child’s username and password. The account login page explains how to recover a password if your child cannot remember it.

Parents can contact Faux Fan® to request access to, change, or delete their child’s personal information by sending an email to us at support@fauxfan.com. A valid request to delete personal information will be accommodated within a reasonable time.

Changes to the Privacy Policy

This Privacy Policy is effective as of October 9, 2019 and will remain in effect unless and until it is revised in the future as required to comply with certain laws, regulations, and internal policies. Changes to the Privacy Policy will be effective immediately upon being posted to this page. We reserve the right to update or change our Privacy Policy at any time. You should check this Privacy Policy periodically. Your continued use of our Service after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the changes and your consent to abide and be bound by the modified Privacy Policy.
